Welcome to Freight By Us, LLC (“Freight By Us,” “we,” “us,” or “our”). These Terms and Conditions (“Terms”) govern your access to and use of our website, digital platforms, online quote requests, and related information and services.
By accessing or using this website, submitting a request for a quote, contacting us through our website, or using any website functionality, you acknowledge that you have read and understood these Terms.
Your use of our transportation, courier, freight, dispatch, or related services may also be governed by separate written agreements, service orders, rate confirmations, bills of lading, customer contracts, or other applicable transportation documents. Where a separate written agreement applies, its terms will govern the specific transaction to the extent of any conflict, subject to applicable law.
If you do not agree with these Terms, you should discontinue use of this website.
Freight By Us, LLC provides logistics and transportation-related services, which may include:
Same-day, expedited, and on-demand courier services.
Final-mile and scheduled delivery services.
Routed and recurring business deliveries.
Freight and cargo van transportation.
Medical courier and healthcare-related deliveries.
Dispatch and logistics coordination services.
Transportation solutions for businesses, shippers, carriers, and authorized commercial partners.
Service availability depends on location, shipment characteristics, vehicle and driver availability, regulatory requirements, customer agreements, and operational capacity.
Freight By Us may perform services directly or coordinate services through qualified third-party carriers, contractors, owner-operators, or other service providers, as applicable to the transaction. The specific role and responsibilities of Freight By Us will be determined by the applicable service agreement, transportation documents, and governing law.
You represent that you are legally capable of entering into binding agreements and that any information you provide to Freight By Us is accurate and complete.
If you use our website or request services on behalf of a company, shipper, consignee, carrier, or other organization, you represent that you are authorized to act on that organization's behalf.
You agree not to use our website or services for any unlawful purpose, fraudulent activity, unauthorized shipment, or activity that violates applicable federal, state, or local laws and regulations.
Quotes, estimates, advertised rates, and pricing information provided by Freight By Us are subject to confirmation and may depend on factors including:
Pickup and delivery locations.
Total mileage and routing requirements.
Shipment dimensions, weight, quantity, and handling requirements.
Vehicle type and equipment requirements.
Service level, delivery windows, and urgency.
Waiting time, additional stops, special handling, and accessorial services.
Tolls, parking, fuel adjustments, and other applicable charges.
Regulatory, security, and compliance requirements.
Unless expressly stated in an applicable written agreement, a quote is not a guarantee that a shipment has been accepted or that a vehicle has been dispatched.
A shipment is considered accepted when Freight By Us confirms the order through an authorized communication or applicable written agreement. Additional charges may apply when shipment details differ materially from the information originally provided, subject to applicable agreements and law.
Freight By Us reserves the right to decline a quote request or shipment that it cannot safely, lawfully, or operationally accommodate.
Customers, shippers, and authorized representatives are responsible for providing accurate shipment information and ensuring that shipments are properly prepared for transportation.
You agree to:
Provide accurate pickup and delivery addresses, contact information, shipment descriptions, weight, dimensions, and handling instructions.
Properly package, label, seal, and prepare shipments unless packaging services are expressly included.
Disclose fragile, temperature-sensitive, high-value, hazardous, regulated, or otherwise special-handling materials before acceptance.
Ensure that you have the legal right and authority to tender the shipment.
Provide accurate delivery instructions and ensure reasonable access to pickup and delivery locations.
Identify any special equipment, loading, unloading, security, or documentation requirements before dispatch.
Pay all properly authorized charges under the applicable service agreement.
Comply with all applicable laws and regulations relating to the shipment.
Freight By Us may refuse, suspend, or discontinue a shipment if information is inaccurate, required documentation is missing, or the shipment presents a safety, legal, security, or compliance concern.
Unless expressly disclosed, reviewed, and accepted in writing by Freight By Us and all required authorized service providers, customers must not tender shipments containing prohibited or restricted items.
These may include:
Illegal substances, contraband, or stolen property.
Undeclared hazardous materials or dangerous goods.
Explosives, firearms, ammunition, or other regulated items that have not been expressly approved for transport.
Cash, negotiable instruments, precious metals, jewelry, or other high-value property requiring special security arrangements.
Perishable, temperature-sensitive, biological, medical, or pharmaceutical materials that require handling conditions not expressly agreed upon.
Live animals, human remains, or other specially regulated materials.
Any item whose transportation is prohibited by applicable law or by an applicable carrier, facility, or service agreement.
This list is not exhaustive. Certain items may be transported when legally permitted and expressly accepted under the appropriate procedures and documentation.
Freight By Us may reject, isolate, return, or arrange lawful handling of an improperly disclosed shipment as circumstances and applicable law permit. The customer may be responsible for reasonable, lawful costs resulting from inaccurate disclosures or unauthorized shipments.
Freight By Us makes reasonable efforts to perform accepted services within the agreed pickup and delivery windows. Unless an authorized written agreement expressly provides otherwise, estimated arrival times, transit times, and delivery windows are estimates rather than guarantees.
Performance may be affected by traffic, weather, road closures, mechanical issues, facility restrictions, shipper or consignee delays, inaccurate addresses, security events, regulatory requirements, and other circumstances beyond reasonable operational control.
Customers are responsible for providing accurate instructions and ensuring that authorized personnel are available when required.
If a delivery cannot be completed because of an incorrect address, recipient unavailability, restricted access, refusal, or other circumstances attributable to the customer or consignee, additional charges or redelivery arrangements may apply under the applicable agreement.
Any guaranteed delivery commitment, service credit, or specific remedy must be expressly stated in an authorized written agreement.
Freight By Us may provide tracking information, electronic notifications, delivery photographs, signatures, timestamps, or other proof-of-delivery records when available for the applicable service.
Tracking information is provided for operational visibility and may be delayed, incomplete, or subject to technical limitations. Tracking status alone does not modify the terms of an accepted shipment.
Proof of delivery generally documents delivery to the recorded location or recipient. It does not necessarily establish the contents, condition, value, or completeness of a shipment unless expressly documented.
Customers should promptly review delivery records and report discrepancies through the contact information provided in these Terms or in their applicable service agreement.
Customers agree to pay the rates, fees, accessorial charges, and other amounts authorized under their accepted quote, rate confirmation, invoice, or written agreement.
Payment deadlines, deposits, credit terms, billing cycles, and applicable late charges will be established by the governing commercial agreement or invoice.
Where no separate payment terms have been agreed upon in writing, payment is due as stated on the applicable invoice.
Customers are responsible for disputing invoice discrepancies promptly and providing sufficient information for review. A billing dispute does not automatically eliminate the obligation to pay undisputed amounts.
Any interest, late fees, collection costs, suspension rights, or other remedies will apply only to the extent permitted by the governing agreement and applicable law.
Cancellation fees, detention, waiting time, redelivery, return transportation, additional stops, storage, special handling, and other accessorial charges may apply when disclosed in or authorized by the applicable quote, rate confirmation, tariff, or written agreement.
Customers should notify Freight By Us as soon as possible when requesting a cancellation, pickup change, delivery change, or other modification.
A cancellation request is not effective until acknowledged through an authorized communication when acknowledgment is required by the applicable service agreement.
Freight By Us will communicate applicable additional charges when reasonably practicable. Charges remain subject to the governing agreement and applicable law.
Freight By Us takes reasonable operational measures to support the safe handling and transportation of accepted shipments. However, transportation involves risks that cannot always be eliminated.
Liability for lost, damaged, delayed, misdelivered, or otherwise affected shipments is determined by the applicable transportation contract, bill of lading, rate confirmation, declared-value arrangement, insurance terms, and governing federal or state law.
Nothing in these website Terms independently establishes a cargo-liability limitation, released value, deductible, or claim deadline for a shipment unless that provision is legally effective under the applicable transportation agreement and governing law.
Customers should notify Freight By Us promptly after discovering a loss, shortage, damage, or delivery discrepancy and preserve relevant packaging, photographs, delivery records, invoices, and other supporting evidence.
Formal claims must be submitted in accordance with the applicable transportation documents and legal requirements. A notification of a problem is not necessarily a formal claim.
Nothing in these Terms waives a right, remedy, or obligation that cannot lawfully be waived or modified.
Freight By Us maintains or obtains insurance as applicable to its operations and contractual obligations. Insurance coverage, limits, deductibles, exclusions, and insured parties vary by policy and may differ among carriers and service providers.
The existence of insurance does not automatically establish coverage for every shipment, item, loss, delay, or claim.
Customers requiring specific cargo insurance, declared-value coverage, additional insured status, or other special coverage must disclose those requirements before shipment acceptance and obtain written confirmation of any agreed arrangements.
Unless expressly confirmed in writing, customers should not assume that the value of a shipment is fully insured or that a particular policy will cover a particular loss.
Medical, pharmaceutical, laboratory, specimen, healthcare-document, and other sensitive shipments may be subject to additional legal, contractual, security, privacy, packaging, and handling requirements.
Such shipments must be disclosed before acceptance, properly packaged and labeled, and accompanied by all required documentation and handling instructions.
Freight By Us will undertake applicable obligations that it has expressly accepted and is legally required to perform. Customers remain responsible for their own legal and regulatory obligations, including those relating to packaging, classification, labeling, authorization, and shipment preparation.
Where protected health information or other regulated personal information is involved, the parties must comply with applicable privacy laws and any required written agreements. A business associate agreement or other specialized compliance agreement may be necessary depending on the parties' roles and activities.
References to healthcare delivery services on our website do not, by themselves, establish that every shipment, service provider, communication channel, or transaction is subject to a particular certification or compliance arrangement.
Certain services may involve dispatch, load coordination, logistics management, carrier referrals, or communication with independent carriers and owner-operators.
The responsibilities of Freight By Us and each third-party provider depend on the specific service performed and the applicable agreements.
Freight By Us will not be deemed to act as a motor carrier, freight broker, or other regulated intermediary solely because of a general description on this website. The actual role, authority, and regulatory obligations applicable to a transaction will be determined by the services performed, contractual arrangements, and applicable law.
Third-party providers may be subject to separate qualification, insurance, licensing, safety, and compliance requirements. Customers and partners must not assume that all third-party services have identical terms or coverage.
Nothing in this section eliminates any duty or liability imposed on Freight By Us by applicable law.
All website content, including text, graphics, logos, designs, images, branding, and other materials owned or licensed by Freight By Us, is protected by applicable intellectual property laws.
You may access and use website content for lawful, personal, or legitimate business-inquiry purposes. You may not reproduce, modify, distribute, publicly display, commercially exploit, or create derivative works from protected content without prior written authorization, except as permitted by law.
You agree not to:
Interfere with the operation, security, or availability of the website.
Attempt unauthorized access to systems, accounts, or data.
Introduce malicious code or engage in automated activity that disrupts the website.
Submit false, misleading, fraudulent, or unlawful information.
Use website content to impersonate Freight By Us or misrepresent an affiliation.
Violate another person's intellectual property, privacy, or other legal rights.
Freight By Us may restrict access to website features where reasonably necessary to protect the website, its users, or its operations.
We make reasonable efforts to maintain accurate and current website information. However, descriptions of services, geographic coverage, availability, pricing, estimated delivery times, and other information may change without notice.
The website and its informational content are provided on an “as available” basis, subject to applicable law. We do not guarantee uninterrupted access, error-free operation, or the accuracy of every third-party or automatically generated data element.
Information published on this website is general information and is not a substitute for an accepted quote, written service agreement, legal advice, or shipment-specific instructions.
Our website may contain links to third-party websites, applications, tracking platforms, payment services, or other external resources.
These third-party services may be governed by their own terms and privacy policies. Freight By Us does not control all third-party systems and is not responsible for their independent content, availability, security practices, or policies, except to the extent liability cannot lawfully be excluded.
The inclusion of a third-party link does not necessarily constitute an endorsement or guarantee of that provider.
Your use of our website may involve the collection and processing of information submitted through contact forms, quote requests, customer communications, or other website features.
Personal information will be handled in accordance with our applicable Privacy Policy and governing law.
By providing contact information and requesting a quote or service, you authorize Freight By Us to use that information as reasonably necessary to respond to your request, communicate about an order, coordinate transportation, provide customer support, and meet applicable legal obligations.
Consent to promotional communications or marketing text messages will be obtained separately when required by law. You may opt out of marketing communications using the instructions provided in those communications.
Do not submit payment-card details, passwords, sensitive medical information, or other highly confidential information through a general website contact form unless the applicable submission channel has been expressly designated for that purpose.
To the maximum extent permitted by applicable law, Freight By Us disclaims implied warranties concerning general website information and website availability, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement where legally excludable.
Nothing in these Terms excludes or limits liability for fraud, intentional misconduct, gross negligence where such limitation is prohibited, personal injury or death where legally non-excludable, or any other liability that cannot lawfully be excluded or limited.
Any limitation of liability relating to an actual transportation service must be determined under the applicable transportation agreement and governing law. These website Terms do not independently impose a universal monetary cap on cargo claims or other transportation-related liabilities.
To the extent permitted by law, Freight By Us will not be liable solely by virtue of website access for indirect, incidental, special, exemplary, punitive, or consequential losses arising from the use of website information or temporary website unavailability. This provision does not override a separate service agreement or eliminate remedies that applicable law requires.
To the extent permitted by applicable law, you agree to be responsible for third-party claims, losses, damages, and reasonable costs arising from your unlawful use of the website, material misrepresentations, violation of these Terms, or breach of your obligations relating to shipment information, packaging, authorization, or prohibited goods.
This section does not require you to indemnify Freight By Us or any other party for that party's own negligence, intentional misconduct, or other conduct where such indemnification is prohibited by law. Any indemnification obligation relating to transportation services remains subject to applicable statutes and the governing written agreement.
Freight By Us may suspend website access or decline future service requests when reasonably necessary because of suspected fraud, unlawful activity, safety concerns, regulatory restrictions, material misrepresentation, nonpayment, or breach of applicable agreements.
Suspension or termination does not eliminate payment obligations or other rights and liabilities that accrued before termination.
Any cancellation or termination of an accepted shipment or ongoing commercial relationship will be governed by the applicable service agreement and law.
These website Terms are governed by the laws of the State of Georgia, without regard to its conflict-of-law principles, except where federal law or another mandatory law governs a particular matter.
Any dispute arising from these website Terms will be brought in a court of competent jurisdiction in Georgia, subject to applicable jurisdictional requirements and any controlling written agreement.
Transportation transactions, interstate shipments, and regulated services may be subject to federal transportation law, other applicable state laws, and separate dispute-resolution provisions contained in governing contracts.
Nothing in this section waives any right or jurisdictional protection that cannot legally be waived.
Freight By Us may revise these Terms periodically to reflect changes in our website, services, business practices, or applicable legal requirements.
The updated version will be published on this page with a revised effective date. Changes will apply prospectively to website use after publication, except where applicable law or a separate written agreement requires otherwise.
Changes to an accepted shipment or existing commercial agreement will be governed by the applicable contract and law. Publication of an updated website version does not automatically amend a previously executed contract.
If any provision of these Terms is determined to be invalid or unenforceable, the remaining provisions will remain effective to the extent permitted by law.
A failure to enforce a provision on one occasion does not constitute a permanent waiver of that provision or any other right.
These Terms govern your general use of the Freight By Us website. They do not replace shipment-specific contracts, customer master service agreements, rate confirmations, bills of lading, carrier agreements, broker agreements, business associate agreements, or other specialized written agreements.
Where different documents apply to the same transaction, their priority will be determined by their express terms, applicable law, and the nature of the specific service.
No amendment to a separate written agreement is effective solely because these website Terms have been published or revised, unless the amendment is validly incorporated under the agreement and applicable law.
